IHC dismisses hotel plea against encroachment

ISLAMABAD: Justice Shaukat Aziz Siddiqui of the Islamabad High Court (IHC) Wednesday, while dismissing the application of a five star hotel of the capital, observed “they could build whatever the security arrangement they want on their premises but do not encroach upon the government land, causing problems for the ordinary citizen and commuters.”

The Marriott Hotel administration had filed this application against a notice served on them on July 06 by the Capital Development Authority (CDA), asking them to remove encroachment from the road under the orders of an IHC.

The appellant adopted before the court that there has been three deadly attacks on the hotel in the past few years. The deadliest September 2008 attack caused a death toll of 31 persons, injuring many others. The attacks caused huge financial loss to the hotel as well, the appellant said. The hotel has been a hub of foreigners and embassies.

The Chairman, Standing Committee on Interior, Senator Talha Mehmood and IG Islamabad police duly approved the security measures, and the CDA authorities confirmed it. As far as the parking lot is concerned, the hotel has been paying to the CDA for the facility, the appellant further adopted.

They prayed to the court to strike down the notices issued to them by the CDA. The court, however, dismissed their application. In another matter, the same IHC bench directed the Federation and Secretary Finance to appoint a permanent President of Zarai Taraqiati Bank Limited (ZTBL) within a period of one month.

The IHC bench issued these orders on the contempt of court application of Senior Vice President of ZTBL, Sohail Mansoor, through his counsel Barrister Afzal Hussain, who has been seeking from the court to initiate contempt proceedings against acting president, ZTBL, Roohi Raees Khan, for violating the court orders.

The petitioner adopted that the acting president has been making appointments on senior slots of the bank and taking major policy decisions against stay orders of the court.
